Firm attorneys have extensive experience briefing and arguing cases in state
and federal appellate courts. We have handled numerous cases in Pennsylvania's
Supreme Court, Commonwealth Court, and Superior Court and in the United States
Court of Appeals for the Third Circuit. Our Firm also has represented clients
before other state appellate courts and in many other federal circuits, including
the Second, Fourth, Fifth, Sixth, Ninth, and Eleventh. In addition to litigating
appeals in which we represented the client in the trial court, we have been
asked to take cases over at the appellate level.
We have won cases in the appellate courts that have been important both to our
clients and to the development of the law. For example: we won the seminal cases
construing the Pennsylvania Charter School Law in the Commonwealth Court and
the Supreme Court; we convinced the Third Circuit that discovery rulings compelling
the disclosure of attorney-client privileged materials could be challenged immediately
through a petition for a writ of mandamus; Firm attorneys won a groundbreaking
decision by the Supreme Court of Pennsylvania recognizing a cause of action for
malpractice against expert witnesses; we persuaded the Pennsylvania Superior
Court to affirm a trial court's decision that a member of a settlement class
that failed timely to request exclusion was precluded from pursuing an individual
suit seeking over $110 million for asbestos abatement; and we persuaded the Supreme
Court of Delaware to affirm the removal of a major financial institution as the
trustee of a family trust of which our client was a beneficiary. We have also
represented the Pennsylvania Gaming Control Board in several cases of original
jurisdiction in the Pennsylvania Supreme Court.
