The Firm has litigated employment disputes concerning the enforcement of employees'
agreements not to compete and misappropriation of employers' trade secrets,
as well as a variety of employment discrimination cases including age, sex,
race, and disability discrimination suits.
In employment discrimination cases, the Firm has primarily defended employers
against such claims, although it occasionally has represented employees. This
experience gives the Firm a unique perspective in evaluating and litigating the
issues involved in discrimination cases, and has proven invaluable in negotiating
the amicable resolution of many employer-employee disputes.
The Firm has represented major brokerage firms, as well as individual financial
advisors, in various employment matters, including departing broker disputes,
employment contracts, trade secret violations, restrictive covenants, and employee
benefits. We have represented clients in all stages of litigation, including
preliminary injunctions and industry arbitrations. For example, we successfully
defended a suit for preliminary injunction by a brokerage firm based on the doctrine
of unclean hands because the plaintiff brokerage firm had engaged in the same
conduct about which it was complaining in its request for preliminary injunction.
In addition, the Firm has worked with employers in drafting or revising employee
handbooks, which are an effective tool in preventing disputes and in defending
against a variety of employment-related claims.
